Mark and Alexis Breyer, Arizona's husband and wife law team and friends of the Charles E. Boyk Law Offices LLC, recently settled a work-injury case for $1.9 million.

The plaintiff in their case was a plumber on a new-home construction site. The accident occurred in 2007.

The general contractor sent the plumber to the job site, where the framers and sub-contractor were moving the stairs. There was no caution tape set up to warn the plumber of this, and when he ascended the stairs to do his work, they collapsed beneath him as he neared the top. The plaintiff's resulting fall caused serious and permanent injuries to his back.

The general contractor and sub-contractor both denied responsibility for the accident, claiming the plumber should not have used the stairs while they were being worked on.

The injured plumber maintained both had a hand in taking responsibility for his injuries, especially since they could have been avoided if right policies and procedures had been set in place and observed.

After deliberating for two days, the jury awarded the plaintiff a $1.9 million settlement, assigning 39% of the responsibility to the general contractor, 58% responsibility to the subcontractor and only 3% to the injured worker.
