According to WTOL, motorcyclist Francis Neal was seriously injured by a driver who pulled out in front of him on Heatherdowns Blvd on Monday. Francis Neal, 35, was transported to Toledo Hospital and listed as in serious condition after being struck by Linda Markwood, 68.
Reports reflect that Markwood pulled out onto Heatherdowns and struck Francis Neal, causing him to be thrown from the motorcycle and the bike to slide through all lanes of traffic before going over the curb.
Our thoughts go out to Francis Neal and his family as he starts his road to recovery. As attorneys who have handled motorcycle accident claims for over 30 years, we understand that many accidents involving bikes can be devastating. It can also be difficult for the victim and the family to focus on recovery when they are being bombarded by the insurance company, which often happens when another driver is at fault.
That being said, anyone involved in an Ohio motorcycle accident must remember the following, in order to preserve their right to a potential monetary settlement:
1. Document the accident scene with photographs and obtain the Toledo crash report. If you are unsure how to do this or who should handle it, contact an attorney and they would be happy to assist you at no charge.
2. Do not talk to the at-fault party's insurance company, even if they are trying to offer you money, without first speaking with a lawyer. Anything you say will most likely be recorded and could ruin your future claim.
3. Do not sign anything before having an attorney review it. Experienced motorcycle accident lawyers will be able to tell you whether or not the paperwork you are about to sign is going to ruin your case.
4. Do not settle your claim until you are absolutely done treating. Accepting money from an insurance company before your medical bills are paid could leave you with the short end of the stick later on.
