Failing to record a land contract not fatal to enforcement

This week, my Legal Briefs column in the Toledo Blade covers the impact of failing to record a land contract. State law requires land contracts to be recorded within 20 days of signing. A reader was concerned that he wouldn't be able to enforce the contract he had with a buyer because he had failed to record. Under the caselaw, though, failing to record shouldn't impact whether this gentleman has a legally enforceable agreement so if his buyer is in default, he should be able to initiate forfeiture proceedings.
