Dad charged with felony after boy falls off ATV | Toledo, Ohio ATV Accident Attorney

Kevin R. Rogers has been arrested on charges of felony child endangerment, which is a third degree felony. Sometime in the beginning of June the defendant was driving a Kawasaki Gator Mule and going north on Hartland Center Road and then when he turned onto East Collins road his 7 year old son fell off. The little boy rolled off the ATV and hit his head on the pavement and he was not wearing a helmet. He was taken to Fisher-Titus Medical Center but then needed to be flown to Akron Children's Hospital and needed to have a couple of surgeries to relieve the pressure on his brain. There were not any signs of an injury until the next day when he was taken to the hospital. The boy's father was driving the ATV on the road with a suspended license. This accident has been under investigation for weeks because the investigators were waiting for medical records. The felony charge was filled by the Norwalk Assistant Law Director; he went through a considerable amount of medical records and found that the boy had to be lifeflighted, and had a serious brain injury; the little boy had 70 something stitches in the back of his head, there was no concern for safety at all, no seat belts or helmets worn and no handles for the little boy to hang on to. There were also allegations that the boy's father was not honest with the staff in the emergency room when asked about how the accident happened.
