Boy Suffers Quadriplegia During Horseplay at High School Track Team Practice | Toledo Ohio Personal Injury Lawyer

Roque Renteria, 14, was a member of his high school track team.  One afternoon several team members began wrestling with one another instead of running laps as the substitute teacher ordered.  The coaches were not present but the substitute teacher was within eyesight and earshot and did not stop the horse playing.

At one point, a team member picked Renteria up and held him upside-down so that his head was pointing to the ground.  The boy allegedly fell, driving Renteria into the turf, severing his spinal cord at C5-6.  Renteria now suffers from quadriplegia. 

Renteria’s mother sued the school district on his behalf, claiming that it failed to supervise the students during practice.

The school district countered that the incident happened so quickly that the coaches had not time to prevent it.  They also stated that Renteria was just at fault as the other students because they were all rough housing. 

The parties settled for $18.4 million, which included $11.4 million structured by the purchase of a single-premium tax-free annuity.
