$1.9 Million Awarded to Family of Young Boy Killed by Bear | Toledo Ohio child injury lawyers

A federal judge awarded $1.95 million to the family of a young boy killed in 2007 by a bear.  The child, Samuel Ives, 11, was camping in  American Fork Canyon whit his family when he was ripped from his family’s tent and killed by a black bear on the night of June 17, 2007.  The District Judge, Dale Kimball said the U.S. Forest Service was required to warn the family that a dangerous animal was on the loose in the canyon after previous reports of a bear opening coolers and slashing tents.

Judge Kimball wrote that the Ive’s family “proved by a preponderance of evidence” that the Forest Service owed them a duty to warn the family of the earlier incidents.  Lawyers for the Forest Service claimed that the government agency was immune from any litigation and it was impossible to prove that any action by the agency could have prevented the bear attack.
